Melindungi Fansub Dengan Lisensi

Fansub adalah salah satu produk yang dihasilkan oleh manusia intelektual. Tentu saja demi menghindari penyalahgunaan, sebaiknya fansub ini dilindungi dengan hak cipta ataupun sebuah model lisensi, demi mencegah penyalahgunaan skrip ini.

Anda mungkin pernah mendengar kasus Odex (lisensor anime dari Singapura), yang menggunakan hasil fansub dari sejumlah fansubber secara ilegal. Selama ini pihak fansubber tidak dapat berbuat apa-apa karena mereka tidak dilindungi lisensi. Fansub hanya dilindungi dengan hukum etika.

Oleh karenanya, fansub harus memiliki sebuah model lisensi yang mampu melindunginya dari penyalahgunaan. KAORIfansub pun memperkenalkan sebuah model lisensi, yakni KAORIfansub Public License.

Inilah isi lengkap lisensi KPL versi 1. Isinya mengambil model GNU FDL, namun dengan banyak bagian yang diketatkan demi melindungi hak cipta.

KAORIfansub Public License, version 1.0
This license, hereby granted for use with KAORIfansub script, but its functionality is not
limited for KAORIfansub works, it also covered any fansub script project which licensed with
KAORIfansub Public License (KPL). Except as otherwise expressly provided in this KPL, you
may not put other license for this project, whether GNU Free Documentation License or
Creative Commons License. If you want to dual licensing it, please use KAORIfansub Lesser
Public License (KLPL).

Preamble:

Fansub practice still growing up, alongside with anime and manga influence in the world.
Regardless of its fansub ethics practice, this license has goals to protect any script for being
misuse, or to sell illegally. A lot of people use the free fansub script and sell it online,
sometimes with irrational price, despite cost to make the fansub but distributed without a
fee.

Despite that, this license has goals to make the fansub script can accessed easily,
translated easily, and can distributed with lowest cost. However, this license doesn’t cover
any copyrighted material, like broadcasting material which subtitled by fans. But for some
obvious reason, this license covering rules to distribute Broadcast Material with the Script, as
long as it haven’t licensed in United States or the respective country.

The Definitions:

1.    “Fan Subtitle or fansub” is an independent work, fan made translation with purpose
for easier for watching any broadcast material, which not always provided in your native
language.
2.    “Script” is a file which contains fan subtitle text, whether timed, arranged, or just a
plain text with translation of any broadcast material.
3.    “Broadcast Material” is a media, electronic file which consist of a video and audio
with purpose to inform, entertaining, or educating the viewers.
Distributing Conditions:
1.    You may use, modify, or distribute the Script, with free of charge, or with charge,
only for accompany the distribution material of fansub. You may not charge a fee for the
material, or to accomplish any cost to get or retranslate of the Script.
2.    You may translate the Script, but you may not charge a fee for translation cost.
3.    You may not sell, rent, or auction the Script or distribute it commercially.
4.    For distribution of the Script with Broadcast Material, you should ensure people
have access to the raw and translation script. If you embed the Script with Broadcast
Material, you must give a Script separately alongside the distribution of Broadcast Material.
This rules applied for some Broadcast Material format which impossible to extract the Script
easily (e.g. AVI file format).
5.    You may not use this script for bootleg or any commercial compilations.
6.    You should retain the first translator’s name or team of the fansub in the Script.

No Warranty
BECAUSE THE SCRIPT IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTY FOR THE
SCRIPT, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE
STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES PROVIDE THE
SCRIPT “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND
PERFORMANCE OF THE SCRIPT IS WITH YOU. SHOULD THE LIBRARY PROVE DEFECTIVE, YOU
ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

How to Apply These Terms to Your Script

If you or your team is fan subbing a series, we recommend you to license it under KPL. With
the benefit, it will encourage distribution of the Script with the Material, and will encourage
others to modify, repair, and retranslate it to their native language so it will broader the
distribution of your work.

You may use this license in your work. You don’t need people to see it while they are
watching, just put this notice at first line of your script:
“COPYRIGHT (C) YEAR YOUR NAME. Permission is granted to modify, translate, or distribute
this script under the terms of the KAORIfansub Public License, version 1.0, or later version
published by KAORIfansub.”

To encourage the first translator, you may add their name in second line in your work.
“Taken from derivate work of TEAM. All Rights Reserved.”

Penjelasan singkatnya, ia membolehkan lisensi secara bebas untuk digunakan. Namun titik utamanya adalah lisensi ini tidak mencakup daripada berkas yang disub itu. Simpelnya seperti ini:

“Tim fansub KAORI membuat fansub anime Kanon. Maka lisensi ini hanya melindungi skrip “.ass” nya saja, namun tidak melindungi sama sekali berkas yang disub (filmnya). Dan bila berkas itu sudah dilisensi, maka ia harus turut kepada hukum hak cipta yang berlaku di negara tersebut.”

Dengan adanya model lisensi ini, diharapkan fansub akan terlindungi dalam segi hukum, dan subber pun memiliki dasar hukum yang jelas untuk melakukan praktik subbing.
